Helpers and Hands Covered by this Policy
This policy applies to the deactivation of any Helper or Hand related to a task occurring within Seattle, or who, within 180 days preceding their deactivation, performed at least 25% of their tasks (or tasks cancelled with cause) within Seattle.
Deactivation Circumstances
Taskrabbit Delivery is committed to ensuring the integrity of its marketplace for the benefit of all of its users. It takes allegations of misconduct seriously, and may deactivate users in the event of an actual or suspect breach of its Terms of Service.
The following actions violate the Taskrabbit Delivery Terms of Service and may result in deactivation:
- Adjustment abuse: Engaging in the manipulation or frequent, unjustified requests for price adjustments during or after Task completion.
- Asking a customer to cancel: Pressuring or persuading customers to cancel their bookings to avoid the Helper/Hand cancelling the Task.
- Attempt to change or changing the start time: Asking, pressuring, or persuading Customers to change the start time after agreeing to the Task.
- Vehicle policy violation: Utilizing a vehicle or trailer to complete Tasks other than the vehicle(s) associated with the Helper’s Taskrabbit Delivery account. Note: Helpers are free to add multiple vehicles to their account.
- Failure to complete OR start / stop a Task: Tasks should be started only when the Helper begins driving to the pickup location and ended immediately after all products are dropped off (i.e., Task completion).
- Gaming the system: Exploiting loopholes or manipulating Taskrabbit Delivery’s policies for personal gain, financial gain, and undermining the fairness and efficiency of the marketplace.
- Price haggling: Engaging in unauthorized negotiation over price with Customers.
- Grossly inappropriate behavior: Displaying conduct that is disrespectful, threatening, discriminatory, or unprofessional towards customers, other contractors, or the Taskrabbit Delivery support team.
- No-show & Assistant no-show: Failing to appear or arrive for a Task, or having an Assistant fail to appear.
- Consistent Lateness: Consistently failing to arrive for Tasks at the time agreed upon with the Customer.
- Going off platform: Encouraging or conducting transactions outside the Taskrabbit Delivery Platform.
- Unapproved person or minor: Utilizing an unapproved or unscheduled person(s) or minor(s) to complete a Task.
- Dispatching: Assigning Tasks to unapproved or unscheduled other person(s). Note: Helpers and Hands are free to utilize Assistants to perform Tasks; however, all Assistants must be registered with Taskrabbit Delivery, agree to the Terms of Service, and pass a background check.
- Drug or alcohol use on a Task: Consuming drugs or alcohol prior to or during a Task.
- Prohibited Tasks: Perform a Task in violation of Taskrabbit Delivery’s Prohibited Task Policy.
Under the terms of Seattle’s App-Based Worker Deactivation Rights Ordinance, Taskrabbit Delivery is prohibited from deactivating a Helper or Hand for any of the following reasons:
- Availability to work or number of hours worked.
- Acceptance or rejection of any type of offer.
- Cancellation of a task “with cause” as defined in Seattle Municipal Code Section 8.37.020.
- Contacting Taskrabbit Delivery.
- Aggregate client ratings of Tasks.
- Any public statements regarding compensation and/or working conditions.
- Asserting their/your legal rights, whether in court or via procedures established by a government agency.
- Results of a background check, consumer report, driver record, or record of traffic infractions, except in cases of egregious misconduct or where required by other applicable law.
Notice of Deactivation and Appeal Procedure
If Taskrabbit Delivery determines that a deactivation is appropriate, we’ll let you know via email. If you get a deactivation notice for any non-egregious conduct, you will have 14 days advance notice and you can challenge the decision through our internal process by replying to the deactivation email. You can start this process as soon as you get the notice, and you have up to 90 days to do so. Taskrabbit Delivery will review and respond to any deactivation challenge within 14 days of receipt. If for some reason we need more time, we'll let you know why and when you can expect to hear from us.
For deactivations involving egregious misconduct, Taskrabbit Delivery will provide Helpers and Hands with a notice of deactivation no later than the effective date of deactivation. Per Seattle’s App-Based Worker Deactivation Rights Ordinance, SMC 8.40:
“Egregious misconduct” means an action or behavior by an individual app-based worker that: (1) endangers the physical safety of the customer, or a third person, the network company, or an animal; or (2) intentionally causes economic harm to the customer, a third person, or the network company; or (3) is threatening, harassing, or abusive to the customer, a third party, or the network company. “Egregious misconduct” includes but is not limited to conduct that occurs outside of an app-based worker’s provision of app-based services or use of the network company’s worker platform if the network company can prove by a preponderance of the evidence that the conduct directly relates to the app-based worker’s fitness to provide app-based services or to use the network company’s worker platform.
Taskrabbit Delivery considers egregious misconduct to include, but to not be limited to: assault, sexual assault, sexual harassment, hate crimes, racial slurs, kidnapping, unlawful possession of a firearm, solicitation of any sexual act, registration as a sex offender, stalking, theft, fraud, robbery, burglary, money laundering, and any other conduct that would constitute a Class A felony offense under Title 9 or 9A RCW as amended.
Taskrabbit Delivery is committed to being fair and transparent with our deactivations policy, and we promise to carefully review each case, communicate clearly, and respect your rights. Taskrabbit delivery is committed to protecting Helpers and Hands from retaliation or discrimination for challenging a deactivation. If you believe you've been retaliated against or discriminated against for challenging a deactivation, let us know. We'll investigate it right away and take action if needed.
